Criminal defence
Advice through investigation and court proceedings starts with the allegation, the procedural stage and the available record.
The matters covered
The practice considers defence during investigation and trial, responses to notices, bail-related steps, criminal appeals and appropriate challenges to proceedings. The FIR and earlier orders are essential starting points.
The applicable criminal framework must be checked carefully. The Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita and Bharatiya Sakshya Adhiniyam coexist with transitional provisions and special statutes; older case records may use the IPC, CrPC and Evidence Act.
Records for an initial review
- FIR or complaint, police notices and details of the investigating authority.
- Arrest, remand, custody and bail orders, where available.
- Charge-sheet and supplied papers, if filed.
- A truthful chronology, relevant communications and information about connected cases.
How the next step is assessed
The review identifies the immediate procedural step and any custody, appearance or response deadline. Advice must distinguish allegation from evidence and identify what material is actually available.
Special statutes, including the NDPS Act, can impose additional requirements. Filing a challenge or sending a representation does not itself prevent lawful investigation or arrest.
Questions that often arise
Can an FIR always be quashed?
No. Quashing is a distinct remedy with specific legal limits. The allegations, record and procedural stage need careful review.
Should earlier bail or connected proceedings be disclosed?
Yes. Complete and accurate disclosure of prior applications and orders is essential to sound advice.
