Service-law disputes — choosing the forum and preparing the record

Employment status, the governing rules and the challenged decision determine the route for a service-law grievance.

Identify the employer and service

Collect the appointment order, employment terms, service rules and relevant notifications. Central, Union Territory, PSU and contractual employment should not be assumed to share one legal route.

Find the actual decision

Identify the order challenged, its date, the authority and when it was communicated. Add any departmental appeal or representation and its outcome. A chronological record helps distinguish a continuing consequence from a fresh legal decision.

Check jurisdiction and limitation

Tribunal coverage, departmental-remedy requirements and limitation must be examined together. The Administrative Tribunals Act and applicable notifications are starting points for CAT-related questions.

There is no reliable universal deadline for all service disputes. Delay and repeated representations can create serious problems; obtain advice on the actual dates.

Prepare evidence for the grievance

For promotion, keep eligibility and seniority records. For pay or pension, keep the calculation and the rule relied on. For disciplinary action, keep notices, replies, inquiry material and operative orders.

Keep the requested remedy focused

Identify whether the issue concerns consideration, correction, payment, procedural fairness or an order’s validity. The legal test and available remedy should match the grievance rather than a general request for fairness.

Prepare for the next step

Keep a complete copy of your records and a short chronology. If there is a live hearing, order or response deadline, mention it before arranging a discussion.
