LEGAL GUIDE · FAMILY, MAINTENANCE AND PROTECTION
Maintenance claimed in more than one proceeding
When maintenance is claimed in multiple proceedings, disclose the other cases, orders and payments. Different legal routes do not justify hiding earlier relief or assuming that identical liabilities can be recovered twice without adjustment.
What to examine
Prepare a single table showing each proceeding, claimant, period, amount ordered and amount paid. Distinguish child support from spousal support and overlapping periods from separate liabilities. The appropriate court should receive the full record when determining adjustment or enforcement. A payer should not make unilateral deductions without understanding the orders and available directions.
Records to collect
- All applications and orders
- payment receipts
- period-wise ledger
- connected-case details
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.
A practical next step
Present a consolidated account and seek clear directions on adjustment where required. Preserve proof showing which obligation a payment was intended to satisfy.
