Power of attorney for a Kashmir property matter from abroad
A power of attorney should authorise the precise work required and satisfy the formalities of the place where it will be used.
Define the job before drafting
Identify the property and the acts the representative must perform. Obtaining records, appearing in proceedings, signing documents and completing a transaction are different powers. A broad template may grant more authority than intended.
Choose and identify the representative
Use accurate names, addresses and identification details. Consider whether the proposed representative has any personal interest in the matter and whether the instructions are clear.
Decide which powers should be limited by the particular property, proceeding, transaction or period. Discuss whether authority can be delegated and how instructions and records will be maintained.
Check execution and use in India
Requirements can depend on the country of execution, citizenship or status, the receiving authority and the proposed use. Consular authentication or apostille, stamping, adjudication and registration are separate questions.
Obtain the receiving authority’s requirements before signing abroad. The relevant Indian mission’s current instructions should be checked for the particular service and appointment.
Separate authority from ownership
A power of attorney authorises an act; it should not be treated as the instrument that automatically transfers ownership. Any intended conveyance must satisfy the applicable law and formalities.
Keep control of the record
Retain the signed document, authentication record, dispatch proof and any registration or stamping record. Keep copies of acts done under the authority. Changes, revocation or an existing dispute require specific advice rather than reliance on an informal message.
Prepare for the next step
Keep a complete copy of your records and a short chronology. If there is a live hearing, order or response deadline, mention it before arranging a discussion.
