LEGAL GUIDE · FAMILY, MAINTENANCE AND PROTECTION
The shared household belongs to a relative
Where a claimed shared household belongs to a relative, ownership is relevant but does not alone dispose of every residence-protection question. The statutory relationship, actual household history and rights of all affected people require careful assessment.
What to examine
Identify who lived there, under what arrangement, for how long and what relief is requested. Disclose the owner's position and connected proceedings. A protective housing direction and a declaration of title have different purposes. Avoid assuming either that residence creates ownership or that a relative's title automatically excludes statutory protection.
Records to collect
- House ownership documents
- household history
- relationship records
- notices and existing orders
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.
A practical next step
Prepare a factual household chronology and identify every affected party. Seek a legally appropriate, practical housing arrangement through the competent proceeding.
