LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT
Retrospective promotion and salary arrears
Retrospective promotion, notional seniority and salary arrears are distinct consequences. Establishing an earlier entitlement does not automatically settle every monetary issue. The governing rule, actual work, reason for exclusion and wording of any order matter.
What to examine
Read the promotion decision and any litigation outcome carefully. Identify the period claimed and whether the relief concerns placement, pay fixation, pension or arrears. A direction to reconsider is different from an order granting promotion and payment. Preserve the authority's consequential calculations and explanations.
Records to collect
- Promotion and review orders
- service history
- pay statements
- judgment and implementation record
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
List each requested consequence separately and calculate the disputed period. Assess the legal basis rather than assuming an earlier date resolves all benefits.
