LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT
An adverse APAR or appraisal entry
An adverse appraisal or APAR entry should be reviewed under the applicable communication and representation rules and its effect on service decisions. Disagreement with an assessment is not enough without identifying the material error or procedural issue.
What to examine
Obtain the complete communicated entry, relevant period and representation deadline. Compare factual criticisms with work records and earlier communications. Distinguish correction of a factual error from a request to substitute a subjective assessment. If promotion was affected, identify the applicable benchmark and decision separately.
Records to collect
- Communicated APAR
- work and performance records
- representation
- promotion criteria and outcome
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Prepare a concise, evidence-based representation. Preserve receipt dates and seek a decision under the applicable process.
