Gratuity is withheld after retirement
A gratuity dispute begins with the governing employment and retirement regime. Statutory gratuity and service-rule retirement benefits should not be assumed to have identical withholding or recovery provisions. Obtain the authority's stated basis for non-payment.
What to examine
Identify the employer, service status, retirement event and benefit calculation. Distinguish delay, disputed eligibility, pending proceedings and proposed deductions. Keep pension and gratuity components separate. A general allegation against an employee does not identify the legal power used, while a withholding provision must be assessed on its own conditions.
Records to collect
- Service and retirement record
- gratuity calculation
- withholding notice
- applicable rules or statute
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Quantify the disputed amount and reason. Identify the competent deciding and reviewing authorities under the actual regime.
