LEGAL GUIDE · TENANCY, CIVIL RECOVERY AND COURT ORDERS
Received an eviction notice in Srinagar — first checks
An eviction notice is not itself a completed eviction order. Identify who issued it, the premises, agreement, legal ground, response date and any court or authority proceeding. Under the 2025 Act, contractual expiry and statutory eviction questions need to be read with the applicable provisions.
What to examine
Check arrears calculations, alleged misuse, subletting or other grounds against the actual record. An older pending case may remain governed by the saved 2012 law. Do not ignore the notice because its wording is disputed, and do not assume that paying one amount resolves every stated ground. Preserve the full envelope or electronic service record.
Records to collect
- Notice and proof of delivery
- agreement and renewal record
- rent payment schedule
- pending-case papers
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The 2025 Act creates separate roles for the Rent Authority, Rent Court and Rent Tribunal. Its definitions, exclusions, agreement-information requirements and savings clause must be considered before selecting a route. Section 40 limits the Rent Court to the tenancy framework and excludes a determination of title or ownership. Current local appointments and submission arrangements should be verified.
A practical next step
Prepare a ground-by-ground response and verify the competent forum and applicable statute promptly. Identify any urgent possession or essential-service issue separately.
