Issuing a cheque-bounce demand notice
A cheque-bounce demand must comply with the Negotiable Instruments Act's requirements for the cheque, return information, demand, dispatch and subsequent process. A generic debt letter may not satisfy the statutory notice requirement. Exact dates should be worked out from the original bank and service record.
What to examine
Check the drawer and account, cheque amount, return reason, underlying liability and correct address. Keep proof of presentation, the bank memo, signed notice and delivery attempts. If the drawer is an entity, identify the legally relevant parties and roles rather than adding everyone associated with the business. Limitation should be checked before dispatch, not after negotiations fail.
Records to collect
- Original cheque
- bank return memo and receipt date
- transaction record
- verified drawer and service details
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Civil relief depends on the claim, correct parties, competent forum and procedural stage. A notice, filing, interim direction and final executable order are different events. Limitation and any request for interim protection should be assessed independently; correspondence or negotiations should not be assumed to suspend either an order or a statutory period.
A practical next step
Have the complete statutory sequence calculated and the demand checked before sending it. Retain originals and diarise the next legally relevant date.
