Working out a legal deadline — the dates to collect
A legal deadline should be calculated from the governing provision, triggering event and actual record. The date an order was made, served, known or copied can have different significance. There is no universal rule that every court challenge allows the same number of days.
What to examine
Collect the order, service proof, copy application and delivery dates, relevant statutory text and holiday information. Special statutes can impose strict outer limits or different computation rules. Negotiations, reminders and informal assurances should not be assumed to extend time. A condonation request, where legally available, needs its own supported explanation.
Records to collect
- Order or notice
- all service dates
- copy application and supply record
- statutory provision and earlier proceedings
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Court procedure varies with the court, case type and current rules or directions. Use official court and eCourts information to locate records and services, then check the signed order for the obligation in your case. A portal entry, private message or general guide should not replace that order.
A practical next step
Prepare a dated chronology and obtain a provision-specific calculation promptly. Set an earlier working date for preparation without treating it as the legal deadline itself.
