LEGAL GUIDE · 18 OCTOBER 2026

Responding to a departmental charge memorandum

A useful response addresses each charge, the supporting documents and the procedure under the applicable service rules.

Read the notice carefully

Record its date, when it reached you, the response deadline and the documents supplied. Identify the authority issuing it and the service rules cited.

Answer the actual allegations

Prepare a charge-by-charge account. Distinguish accepted facts, disputed facts and matters requiring records. Support the response with documents and avoid speculation about motives.

Request what is missing

List the documents or particulars needed to respond properly. Request them through the applicable procedure, and keep acknowledgement. If an extension is needed, seek it expressly; do not assume a request automatically extends the deadline.

Track the inquiry process

Keep notices, hearing records, document requests, witness material and orders. Procedural requirements vary by service and by the type of action. Central-service procedures are not a universal substitute for the governing rules.

Review the order and available remedy

If a penalty or other decision is made, preserve the complete order and communication record. The appropriate appeal, review or tribunal route and its time limit require specific assessment.

Prepare for the next step

Keep a complete copy of your records and a short chronology. If there is a live hearing, order or response deadline, mention it before arranging a discussion.
