LEGAL GUIDE · MEDIATION AND ARBITRATION

An arbitrator has a possible conflict of interest

A possible arbitrator conflict should be assessed through the Arbitration and Conciliation Act, applicable disclosures and the appointment record. Prior relationships, statutory ineligibility and an ordinary disagreement with a procedural decision are different issues. Not every allegation follows the same challenge route.

What to examine

Obtain the appointment communication, disclosure statement and facts supporting the concern. Record when those facts became known because timing can matter. An appointment clause and any purported waiver require careful legal assessment; do not assume a broad clause cures every statutory problem. Continue to follow binding procedural directions unless the competent forum orders otherwise.

Records to collect

  • Arbitration agreement
  • appointment and disclosure records
  • documented relationship or conflict facts
  • procedural orders

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Mediation is a process for exploring lawful agreement; arbitration is an adjudicatory process based on the applicable legal framework. The agreement, referral, institution and effective statutory provisions matter. A procedural label alone does not establish confidentiality, enforceability, court jurisdiction or the time available for a challenge.

A practical next step

Identify whether the issue concerns disclosure, challenge, ineligibility or termination of mandate. Use the correct mechanism promptly with supported facts rather than an unsupported accusation.
