LEGAL GUIDE · FAMILY, MAINTENANCE AND PROTECTION
An income affidavit appears incomplete or inaccurate
An allegedly inaccurate financial affidavit should be addressed through specific discrepancies and lawful procedural requests. Suspicion about hidden income is not the same as proof of a false statement, and unauthorised access to private accounts is not an appropriate evidence-gathering method.
What to examine
Compare the affidavit with reliable records and earlier disclosures. Identify missing accounts, inconsistent employment information or unexplained entries without overstating what a transaction proves. Requests for documents, clarification or other directions should relate to a material issue in the case. Preserve the complete affidavit and its annexures, not just the challenged page.
Records to collect
- Financial affidavit
- reliable contradictory records
- earlier disclosures
- orders directing production
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.
A practical next step
Prepare a discrepancy table with the source of each point. Seek appropriate directions and assess any further remedy on the evidence and the court's procedure.
