Child custody and maintenance — preparing for legal advice

Organised information helps distinguish immediate needs from the longer-term questions about care, access and financial support.

Start with existing arrangements

Make a short note of where the child lives, the daily care arrangement, schooling, health needs and how each parent is currently involved. Include any existing court order or written agreement.

Keep the child’s welfare central. The relevant legal test and forum depend on the application and the facts; a generic rule about one parent always receiving custody is unreliable.

Prepare a realistic financial record

For maintenance-related questions, collect income records, available bank statements, regular expenses and information about dependants. Identify what is documented and what remains unknown.

School fees, medical needs, housing and other necessary expenses should be supported where possible. A budget is more useful when it separates recurring costs from one-off expenditure.

Bring the procedural history

Include marriage records, notices, petitions, replies and every operative interim or final order. Disclose connected matrimonial, domestic-violence or other proceedings so advice can take the complete position into account.

Raise urgent safety or access concerns

If there is an immediate risk, a pending handover or an imminent hearing, explain it at the outset. Do not assume that a proposed informal arrangement overrides an existing order.

Mediation may be considered where appropriate, but safety, coercion and the ability to participate freely need attention. Participation should not be treated as an automatic answer to every family dispute.

Keep the first enquiry brief

Begin with the names of the parties, the broad issue and the next deadline. Agree how sensitive documents will be shared after the initial conflict and engagement checks.

Prepare for the next step

Keep a complete copy of your records and a short chronology. If there is a live hearing, order or response deadline, mention it before arranging a discussion.
