LEGAL GUIDE · PUBLIC LAW AND WRIT REMEDIES

Delay in bringing a writ petition

Delay can affect discretionary writ relief even where no simple universal filing period answers the question. The nature of the decision, knowledge, explanation, changed circumstances and third-party rights matter. Repeated reminders do not automatically make an old dispute fresh.

What to examine

Prepare an honest timeline from the original action to the proposed petition. Identify illness, access problems, earlier proceedings or other facts with documents where relevant. Distinguish a continuing legal wrong from continuing consequences of an earlier decision. A court's power to consider a delayed matter is not a promise that the explanation will be accepted.

Records to collect

  • Original and later orders
  • knowledge and service dates
  • representation record
  • documents explaining the delay

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Public-law remedies depend on the authority, legal duty, statutory framework and actual decision or inaction. The High Court assesses maintainability and grounds for review as well as the relief requested. Statutory appeals, tribunal jurisdiction, delay and affected third parties should be considered before choosing a writ petition.

A practical next step

Obtain a prompt delay-and-remedy assessment. State the real chronology and any condonation or equitable issues rather than relying on a recent reminder date alone.
