LEGAL GUIDE · FAMILY, MAINTENANCE AND PROTECTION
Does a spouse's employment end a maintenance claim?
A spouse's employment does not by itself answer every maintenance claim. The relevant court examines the applicable law, actual earnings, reasonable needs and other circumstances. Capacity to earn and income actually available should not be treated as the same fact.
What to examine
Compare the nature and stability of the employment, expenses, care responsibilities and the financial positions disclosed by both parties. Explain whether the claim concerns interim support, final maintenance or another statutory remedy. Avoid assuming either that any job defeats the claim or that an income gap automatically produces a particular award.
Records to collect
- Employment and pay records
- essential expenses
- care responsibilities
- earlier disclosures and orders
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.
A practical next step
Prepare an accurate comparison of resources and needs. Address the particular legal test and disclose existing support instead of relying on employment status as a slogan.
