Family pension after a government employee dies
Family-pension eligibility depends on the applicable service rules and the claimant's relationship and circumstances. It is not simply distribution of the deceased employee's estate among all heirs. Competing claims require a rule-based assessment.
What to examine
Obtain the employee's service and nomination record, death certificate and relationship documents. Identify marriage, dependency, age or other conditions material under the relevant rules. A nomination and a legal entitlement may raise different issues. Disclose earlier payment decisions and competing claimants rather than presenting a single incomplete family account.
Records to collect
- Death and service records
- relationship documents
- nomination or pension papers
- competing claims
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Prepare a complete claimant chronology and identify the governing eligibility provisions before demanding an equal share among heirs.
