Grandparents seeking contact or guardianship

Grandparent contact and legal guardianship are different questions. Standing, the child's existing care arrangements and the governing law need assessment. A close family relationship alone does not determine that a grandparent can replace a parent or obtain a particular contact arrangement.

What to examine

Identify whether the concern is loss of contact, parental incapacity, an emergency or management of the child's affairs. Explain the actual relationship and welfare concern without treating the application as an extension of an adult family quarrel. Existing custody orders and the child's circumstances must be disclosed.

Records to collect

  • Relationship proof
  • care and contact history
  • existing orders
  • relevant welfare information

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.

A practical next step

Define the precise request and why it serves the child. Assess the appropriate legal route rather than using a custody format for every contact concern.
