LEGAL GUIDE · FAMILY, MAINTENANCE AND PROTECTION
Moving to another Indian city with a child after separation
Relocation within India after separation can affect schooling, care and contact. Whether consent or court directions are needed depends on the existing orders and facts. A parent should not assume that a domestic move is legally irrelevant simply because no international border is crossed.
What to examine
Explain the reason for the move, housing, schooling, support network and how contact will continue. Identify any restriction in a current order and the other parent's objections. A proposal based on the child's practical needs is more useful than a surprise move followed by an assertion that the matter is already settled.
Records to collect
- Custody and contact orders
- relocation proposal
- schooling and housing details
- contact plan
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.
A practical next step
Seek agreement or appropriate directions before acting inconsistently with an order. Address travel costs, handovers and the effect on the child's established routine.
