LEGAL GUIDE · FAMILY, MAINTENANCE AND PROTECTION
School holidays and temporary custody arrangements
Temporary custody during school holidays is a welfare and practical-planning question, not a simple entitlement to half of every vacation. Existing orders, the child's routine, travel and the parents' circumstances need to be considered.
What to examine
Propose definite collection and return arrangements, location, contact with the other parent and treatment of school or medical commitments. Disclose travel outside the usual area and relevant restrictions. Where an order already exists, seek an agreed variation or appropriate direction rather than treating a holiday invitation as permission to depart from it.
Records to collect
- Custody and contact orders
- school calendar
- travel proposal
- care and medical arrangements
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.
A practical next step
Present a child-centred schedule early enough for meaningful consideration. Identify who will care for the child and how the arrangement will be carried out safely.
