Selection list, waiting list and appointment — different legal positions
Inclusion in a selection or waiting list does not automatically guarantee appointment in every recruitment. The governing notice, vacancies, list validity and the authority's lawful decisions require examination. A waiting list is not an unlimited source of future appointments.
What to examine
Identify the advertised posts, your position, categories, appointments actually made and reasons for any non-joining or cancellation. Distinguish a claim within the recruitment from a demand against later vacancies. Preserve the list and its stated validity rather than assuming that correspondence keeps it alive indefinitely.
Records to collect
- Advertisement
- selection and waiting lists
- appointment or cancellation orders
- representations
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Connect the claimed vacancy to the relevant list and rules. Seek a reasoned assessment of any refusal or inaction before assuming a right from rank alone.
