LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD
Sending original documents from abroad for a Kashmir matter
Original documents sent from abroad need a clear custody and return process. Before sending them, confirm whether the receiving authority requires originals, certified copies or another form of verification. A representative should not hold irreplaceable papers without a documented purpose.
What to examine
Inventory each item, keep complete scans, identify the recipient and use an appropriate tracked delivery method. Record handovers, court deposits and return arrangements. Authentication or translation may need to occur before dispatch. Do not send unrelated identity or financial papers merely because a broad document list was requested.
Records to collect
- Document inventory and scans
- recipient's written requirement
- delivery and receipt record
- return instructions
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.
A practical next step
Agree the permitted use, responsible holder and return event in advance. Reconcile the inventory when originals are returned or lodged with an authority.
