LEGAL GUIDE · TENANCY, CIVIL RECOVERY AND COURT ORDERS

Subletting or sharing a rented shop without consent

Section 7 of the 2025 Act restricts subletting, assignment or transfer of tenancy rights without the required supplementary agreement. It also requires information about an agreed sub-tenancy to the Rent Authority. Calling an arrangement 'sharing' does not settle its legal character.

What to examine

Look at who controls the shop, carries on the business, pays rent and has access. A genuine employee, family helper, business partner and independent occupant may raise different factual issues. Preserve the original agreement, landlord's written consent if any, business records and payment trail. Do not manufacture a supplementary agreement after a dispute begins.

Records to collect

  • Original and supplementary agreements
  • written consent
  • business and occupation records
  • rent and other payment records

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

The 2025 Act creates separate roles for the Rent Authority, Rent Court and Rent Tribunal. Its definitions, exclusions, agreement-information requirements and savings clause must be considered before selecting a route. Section 40 limits the Rent Court to the tenancy framework and excludes a determination of title or ownership. Current local appointments and submission arrangements should be verified.

A practical next step

Assess the actual arrangement against the agreement and statute. Seek a lawful written arrangement or respond to the specific allegation with evidence rather than relying on labels.
