LEGAL GUIDE · FAMILY, MAINTENANCE AND PROTECTION
The marriage was not registered — proving marital status
Lack of a marriage-registration certificate raises a proof and compliance question; it does not produce one universal conclusion about validity across marriage laws. Identify the governing law, ceremony and available records before assuming either a valid marriage or no marriage.
What to examine
Collect contemporaneous evidence of solemnisation, witnesses, community or religious records and later official documents where relevant. Distinguish delayed registration from a dispute over whether a legally required ceremony or condition existed. A registration application should be accurate and should not create a false history to address a litigation problem.
Records to collect
- Ceremony and witness records
- nikahnama where applicable
- identity documents
- later records referring to the marriage
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.
A practical next step
Assess validity, proof and registration as separate issues. Identify the receiving authority's current requirements and disclose any existing marital-status dispute.
