LEGAL GUIDE · MEDIATION AND ARBITRATION
Urgent interim protection before or during arbitration
Urgent protection connected with arbitration may be sought through the court or tribunal route available under the Arbitration and Conciliation Act. The tribunal's constitution, effectiveness of its remedy, seat and nature of relief affect the assessment. Interim protection does not finally decide the claim.
What to examine
Explain the specific threatened act, urgency, asset or evidence at risk and the proposed order. Preserve the contract, invocation and appointment record. A general fear that the opponent will not pay is different from documented conduct requiring preservation. Any order may carry conditions and a requirement to move the arbitration forward promptly.
Records to collect
- Arbitration agreement
- dispute and invocation record
- urgency and asset evidence
- existing tribunal or court orders
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Mediation is a process for exploring lawful agreement; arbitration is an adjudicatory process based on the applicable legal framework. The agreement, referral, institution and effective statutory provisions matter. A procedural label alone does not establish confidentiality, enforceability, court jurisdiction or the time available for a challenge.
A practical next step
Assess the correct interim forum and request only a supported, workable order. Diarise every condition and follow-on arbitration step imposed by the court or tribunal.
