LEGAL GUIDE · TENANCY, CIVIL RECOVERY AND COURT ORDERS
You won a money decree — what happens in execution?
A money decree usually requires execution if the judgment debtor does not comply voluntarily. The decree holder must identify the executable terms, outstanding amount, competent court and lawful enforcement method. Winning the suit does not itself identify attachable assets or complete recovery.
What to examine
Check interest, costs, payments and any appeal or stay. Asset information must be obtained lawfully and linked to the judgment debtor; property belonging to relatives or another company is not automatically available. Objections, exemptions and execution procedure can affect the route. Keep settlement payments recorded so the execution claim remains accurate.
Records to collect
- Certified decree and judgment
- payment and interest calculation
- stay or appeal orders
- lawfully available debtor asset information
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Civil relief depends on the claim, correct parties, competent forum and procedural stage. A notice, filing, interim direction and final executable order are different events. Limitation and any request for interim protection should be assessed independently; correspondence or negotiations should not be assumed to suspend either an order or a statutory period.
A practical next step
Prepare an updated decree account and an execution strategy suited to identifiable assets. Record satisfaction or settlement through the proper court process when payment is made.
