Family mediation where violence or coercion is alleged
Mediation in a family dispute requires informed, voluntary participation. Where violence, coercion or a serious power imbalance is alleged, suitability and protective arrangements need assessment before expecting direct negotiations or a binding settlement.
What to examine
Identify current protection orders, immediate safety needs and the participant's ability to obtain advice and make decisions freely. Separate discussions, support arrangements or postponement may be appropriate, depending on the process. Mediation should not be used to pressure someone to abandon urgent protection or to treat safety allegations as merely a bargaining position.
Records to collect
- Existing protection orders
- relevant risk information
- issues proposed for mediation
- authority and support arrangements
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.
A practical next step
Raise suitability and safety concerns with the appropriate professional or forum before the session. Keep urgent protective steps and voluntary settlement discussions clearly distinguished.
