LEGAL GUIDE · MEDIATION AND ARBITRATION

A signed mediation settlement — how can it be enforced?

Enforcement of a mediated settlement depends on the legal route used and the document ultimately recorded. A court compromise, a settlement under a particular statute and a private agreement do not automatically have the same effect. A signature alone does not identify the enforcement mechanism.

What to examine

Check the proceeding or mediation reference, mediator's role, parties, authority to sign and whether a court or other competent body recorded the terms. The Mediation Act 2023 should be read with its commencement notifications and applicable transitional rules, rather than assuming every provision applies to every settlement. Property transfer, registration, tax and statutory permissions may require additional steps.

Records to collect

  • Signed settlement and annexures
  • mediation referral or agreement
  • court or statutory recording order
  • proof of performance and default

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Mediation is a process for exploring lawful agreement; arbitration is an adjudicatory process based on the applicable legal framework. The agreement, referral, institution and effective statutory provisions matter. A procedural label alone does not establish confidentiality, enforceability, court jurisdiction or the time available for a challenge.

A practical next step

Identify the settlement's legal character and exact unperformed obligation. Obtain advice on enforcement or recording before treating it as an executable decree.
