LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT
CAT limitation and delay — when a service grievance needs prompt review
A CAT application requires a limitation assessment based on the final order, any legally relevant representation or appeal and the statutory rules. Repeated reminders should not be assumed to restart time. Delay may need a supported explanation and a specific condonation request.
What to examine
Separate the challenged decision from later correspondence merely repeating it. Preserve service, receipt and copy dates. The requirement to pursue an available departmental remedy and the tribunal's limitation rules must be considered together; they are not interchangeable. Urgency about salary, retirement or joining should be identified separately from the merits.
Records to collect
- Final order
- departmental appeal or representation
- receipt evidence
- date-wise correspondence
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Prepare a complete dates table and obtain a forum and limitation assessment before waiting for another informal assurance.
