Departmental appeal, review and revision — choosing the available route
Appeal, review and revision are distinct powers under the relevant service regime. They may differ in authority, grounds and time requirements. A further representation should not be labelled an appeal unless it invokes an available remedy correctly.
What to examine
Read the final order, applicable rules and any remedy already used. Identify the decision sought and whether the proposed authority has that power. Repeated applications may not cure delay or create another appeal. Preserve the complete chain of decisions so the next filing challenges the correct operative order.
Records to collect
- Original and appellate orders
- governing rules
- earlier applications
- receipt and communication dates
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Map the available remedies and completed steps. Prepare the required grounds and documents for the actual power being invoked.
