Prolonged suspension and review of the suspension order
Prolonged suspension requires examination of the applicable review requirements, reasons and current proceeding status. Suspension is not itself the final disciplinary penalty, but continuing it should not be assessed without the governing rule and record.
What to examine
Obtain the original order, later review or extension decisions and details of the inquiry or criminal case. Identify who is competent to review the order and what material was considered. Do not transplant a review interval from another service regime without checking applicability. Salary-related claims may require separate attention.
Records to collect
- Suspension and review orders
- proceeding chronology
- representations
- allowance records
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Prepare a review timeline and identify missing decisions or reasons. Seek the appropriate reconsideration or challenge with the current proceeding status clearly stated.
