LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT
An inquiry proceeds without the employee
An ex parte departmental inquiry requires checking notice, opportunity and the reason for absence. The label ex parte does not by itself establish either illegality or a valid finding. The applicable rules and evidence still matter.
What to examine
Obtain hearing notices, delivery records and proceedings. Explain illness, non-service or other obstacles with supporting material, distinguishing them from a deliberate refusal to attend. Ask what stage the inquiry has reached and whether participation or recall is procedurally available. Do not assume that writing a representation automatically reopens concluded proceedings.
Records to collect
- Notice and service record
- hearing proceedings
- absence explanation
- inquiry report and final order if any
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Act promptly to place the factual explanation on record. Assess participation, recall, appeal or challenge according to the actual stage.
