LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT
Departmental inquiry documents or cross-examination are refused
Refusal of relevant documents or a proper opportunity to test evidence in a departmental inquiry can raise fairness issues. The request should identify the material, its relevance and the actual prejudice; not every refusal has the same legal consequence.
What to examine
Keep written requests, the inquiry officer's response and the stage at which the issue arose. Distinguish relied-on documents from unrelated material and an opportunity offered from one declined. Record objections clearly without assuming that non-participation is always the appropriate response. The applicable inquiry rules and record remain central.
Records to collect
- Charge memorandum
- document requests
- orders and hearing record
- relied-on evidence
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Explain how the refused material affects the response to a charge. Seek a recorded ruling and assess further remedies at the appropriate stage.
