LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT

Salary is unpaid for work already performed

A claim for unpaid salary should establish the engagement, period worked, entitlement and reason payment was withheld. Proof of attendance is important but may not answer every dispute about appointment, sanction or the applicable pay terms.

What to examine

Prepare a period-wise statement linking work to the order and payment rate claimed. Distinguish arrears, disputed fixation, unauthorised-absence deductions and a contested employment relationship. Preserve acknowledgments of work and prior payments. The correct forum may depend on the employee's status and the nature of the claim.

Records to collect

  • Appointment or engagement
  • attendance and work records
  • pay terms and receipts
  • withholding communication

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.

A practical next step

Quantify the claim and address the stated objection. Identify the competent authority and available recovery or service remedy.
