Termination during probation — simple discharge or punitive action?
Termination during probation requires examining the applicable rules, appointment terms and the substance of the action. A simple discharge and a punitive termination based on misconduct may raise different procedural questions. The heading of the order alone is not decisive.
What to examine
Read the order with the record that led to it, including performance assessments, notices and allegations. Identify whether the employee had the status and protection claimed and whether an opportunity was legally required. Avoid assuming every probationer has an identical tenure right or that every non-stigmatic form resolves the issue.
Records to collect
- Appointment terms
- probation rules
- assessment and notices
- termination order
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Prepare a chronology connecting the stated reason and underlying action. Assess the remedy and filing dates using the actual employment regime.
