LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD
Maintenance where one spouse lives abroad
Where one spouse lives abroad, maintenance questions include the applicable legal route, jurisdiction, service, income evidence and enforcement. An overseas address does not automatically defeat a claim or make an Indian order readily enforceable in every country.
What to examine
Identify where the parties live, the marriage law, dependants and existing orders. Preserve lawful foreign income evidence and currency information without assuming an apparent lifestyle establishes exact earnings. Service and cross-border enforcement may require country-specific steps distinct from obtaining the initial order.
Records to collect
- Marriage and residence records
- income and expense evidence
- foreign address
- existing orders
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.
A practical next step
Prepare a jurisdiction and service plan and a realistic enforcement assessment. Separate the support calculation from the mechanics of recovering it abroad.
