LEGAL GUIDE · CRIMINAL PROCESS AND BAIL

FIR quashing, discharge and trial defence — different stages

Quashing asks the High Court to intervene within its criminal jurisdiction. Discharge is considered at the appropriate pre-trial stage under the governing procedure. Trial defence tests the prosecution case through the trial process. These routes have different thresholds and are not interchangeable shortcuts.

What to examine

An allegation that the complaint is false must be translated into a legally relevant ground and supported by the permissible record. A disputed factual defence may require evidence rather than summary determination. Identify whether an FIR, police report, charge order or trial evidence is available. Pending bail, protective or family proceedings should also be disclosed.

Records to collect

  • FIR and complaint
  • police report and annexures
  • charge or discharge orders
  • existing protection orders

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Criminal procedure must be matched to the alleged offence, case stage, applicable special statute and any transition from the older laws. Bail, investigation, trial and property-release questions can follow different provisions. Official case information helps locate the matter; the complete police and court records are needed to assess the particular application.

A practical next step

Map the current stage and exact relief required. Assess the appropriate route against that record before filing parallel applications with inconsistent factual positions.
