LEGAL GUIDE · TENANCY, CIVIL RECOVERY AND COURT ORDERS
Electricity or essential services are cut off in a tenancy dispute
Section 20 of the 2025 Act prohibits a landlord or property manager from withholding essential supplies or services and provides a Rent Authority process, including possible interim restoration. First establish whether the interruption is caused by a person, a utility fault or an unpaid utility liability.
What to examine
Preserve meter details, outage messages, bills, photographs and communications about the disconnection. Explain urgency where water, sanitation or other essential use is affected. The provision does not authorise unsafe reconnection or interference with utility equipment. Where applicability or responsibility is disputed, the agreement and supply records help identify the proper respondent and remedy.
Records to collect
- Agreement
- utility bills and meter details
- disconnection evidence
- messages identifying the alleged cause
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The 2025 Act creates separate roles for the Rent Authority, Rent Court and Rent Tribunal. Its definitions, exclusions, agreement-information requirements and savings clause must be considered before selecting a route. Section 40 limits the Rent Court to the tenancy framework and excludes a determination of title or ownership. Current local appointments and submission arrangements should be verified.
A practical next step
Report a utility fault through the utility's proper channel and assess an urgent statutory application where deliberate withholding is alleged. Keep restoration requests factual and documented.
