LEGAL GUIDE · GOVERNMENT EMPLOYEES, RECRUITMENT AND CAT
Eligibility cut-off dates and equivalent qualifications
Eligibility and equivalent qualifications are assessed against the governing recruitment rules and advertisement. A qualification that appears academically higher is not automatically equivalent to the one prescribed. The relevant cut-off and any valid clarification matter.
What to examine
Compare the exact wording, issuing authority, course and dates. Distinguish possessing a qualification from obtaining or producing its certificate. If equivalence is claimed, identify the legally competent recognition or decision rather than a general similarity between syllabuses. Do not change the qualification history in a later representation.
Records to collect
- Recruitment rules
- advertisement
- qualification and result dates
- equivalence decision or clarification
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
For J&K employment matters, identify the governing service or recruitment rules and amendments before applying a general principle. CAT coverage depends on the employer and subject matter, while territorial allocation is a separate question. The High Court copy of the CCA Rules is a starting text for covered matters, not proof that every employee or issue falls under those Rules.
A practical next step
Prepare a criterion-by-criterion comparison and explain the disputed interpretation with the relevant official material.
