LEGAL GUIDE · TENANCY, CIVIL RECOVERY AND COURT ORDERS
Appealing a rent order and seeking interim protection
Under the 2025 Act, an order of the Rent Authority is appealable to the Rent Court under section 32; an order of the Rent Court is appealable to the Rent Tribunal under section 37. Both provisions state a thirty-day period from the order. Identify the actual order and route immediately.
What to examine
Do not assume that filing an appeal automatically suspends the order. Interim protection requires its own assessment and request. Obtain the complete order, service and copy details, and identify current district appointments and filing practice. A saved older proceeding may have a different appeal framework. Any delay issue requires specific advice rather than a general assurance that time can always be extended.
Records to collect
- Signed order
- date and service record
- copy application and receipt
- underlying pleadings and compliance record
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The 2025 Act creates separate roles for the Rent Authority, Rent Court and Rent Tribunal. Its definitions, exclusions, agreement-information requirements and savings clause must be considered before selecting a route. Section 40 limits the Rent Court to the tenancy framework and excludes a determination of title or ownership. Current local appointments and submission arrangements should be verified.
A practical next step
Calculate time from the governing provision and seek advice promptly. Prepare the appeal grounds and a distinct, supported request for any necessary interim protection.
