LEGAL GUIDE · TENANCY, CIVIL RECOVERY AND COURT ORDERS

A rented shop or commercial premises under the new tenancy law

Commercial premises can fall within the non-residential provisions of the 2025 Act, subject to its definitions, exclusions and savings. A rented shop is not outside tenancy law merely because a business operates there. Industrial use and hotel-type accommodation require particular classification checks.

What to examine

Read the permitted use, fit-out rights, signage, repairs, deposit, renewal and subletting terms. A dispute about stock, business losses or a separate supply contract may require relief beyond the tenancy forum. The Act limits the Rent Court's jurisdiction and does not make it a general court for every business disagreement between the parties.

Records to collect

  • Shop tenancy and information record
  • business-use and fit-out terms
  • deposit and rent records
  • notices and pending proceedings

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

The 2025 Act creates separate roles for the Rent Authority, Rent Court and Rent Tribunal. Its definitions, exclusions, agreement-information requirements and savings clause must be considered before selecting a route. Section 40 limits the Rent Court to the tenancy framework and excludes a determination of title or ownership. Current local appointments and submission arrangements should be verified.

A practical next step

Separate possession and rent questions from other commercial claims. Verify the applicable tenancy route before treating the dispute as an ordinary business recovery suit.
