LEGAL GUIDE · TENANCY, CIVIL RECOVERY AND COURT ORDERS

A loan was made without a signed agreement

A loan without a signed agreement may still raise a recoverable claim, but the lender must prove the transaction, terms and unpaid amount through admissible evidence. A bank transfer alone may not explain why money was paid. The borrower's account of the payment also matters.

What to examine

Preserve complete messages, transfer descriptions, repayment conduct and contemporaneous witnesses or records. Identify any interest agreement without inventing terms later. Cash transactions can raise additional evidentiary and legal issues. If the parties dispute whether the payment was a gift, business investment or loan, address that issue directly rather than hiding it in a total balance.

Records to collect

  • Bank or cash evidence
  • complete messages
  • repayment history
  • contemporaneous account or witness details

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Civil relief depends on the claim, correct parties, competent forum and procedural stage. A notice, filing, interim direction and final executable order are different events. Limitation and any request for interim protection should be assessed independently; correspondence or negotiations should not be assumed to suspend either an order or a statutory period.

A practical next step

Build a transaction-by-transaction chronology and assess proof, limitation and cost before choosing a recovery route. Record any settlement in clear written terms.
