LEGAL GUIDE · TENANCY, CIVIL RECOVERY AND COURT ORDERS

An ex parte civil decree is passed against you

An ex parte decree should be addressed promptly through the remedy appropriate to the record. Questions about service, sufficient cause for absence, appeal and setting aside are distinct and carry their own requirements. Learning of the decree does not automatically stop execution.

What to examine

Obtain the decree, judgment, summons service record and order sheets. Keep evidence of the date and manner in which you learned of the case and any reason for non-appearance. A challenge should explain the relevant ground accurately. Do not assume that filing any application automatically restores a defence or stays enforcement.

Records to collect

  • Judgment and decree
  • summons and service record
  • order sheets
  • absence and knowledge-date evidence

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Civil relief depends on the claim, correct parties, competent forum and procedural stage. A notice, filing, interim direction and final executable order are different events. Limitation and any request for interim protection should be assessed independently; correspondence or negotiations should not be assumed to suspend either an order or a statutory period.

A practical next step

Get limitation and remedy advice immediately, including any separate request to stay execution. Follow the actual court order while the challenge is pending.
