LEGAL GUIDE · PUBLIC LAW AND WRIT REMEDIES
An RTI request is refused or unanswered
An unanswered or refused RTI request should be assessed under the RTI Act's designated appeal or complaint framework. The proper route depends on the response, dates and issue. An information request cannot itself compel a different administrative decision or substitute for a pending case's disclosure process.
What to examine
Retain the application, fee and submission proof, transfer communication and PIO response. Identify the precise information sought rather than expanding the dispute into a general grievance. Exemptions, third-party procedure and existing records matter. Verify the competent appellate or information authority for the public body instead of relying on a pre-reorganisation J&K address.
Records to collect
- RTI application
- fee and delivery record
- PIO response or transfer
- public-body and authority details
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
Public-law remedies depend on the authority, legal duty, statutory framework and actual decision or inaction. The High Court assesses maintainability and grounds for review as well as the relief requested. Statutory appeals, tribunal jurisdiction, delay and affected third parties should be considered before choosing a writ petition.
A practical next step
Calculate the applicable response and appeal dates from the actual record. Use the correct statutory route and keep the underlying substantive remedy under separate review.
