LEGAL GUIDE · FAMILY, MAINTENANCE AND PROTECTION
A senior citizen transferred property and promised care is not provided
A transfer by a senior citizen followed by failure to provide promised care can raise a statutory challenge, but revocation is not automatic in every family gift. The applicable provision, transfer terms, conditions and evidence of failure need examination.
What to examine
Obtain the full deed and identify whether the transfer was subject to providing basic amenities or physical needs in the legally relevant sense. Explain what was promised, what was provided and what is alleged to have failed. Ownership, maintenance and occupation remedies may interact but are not identical. Avoid relying only on a later oral description of the deed.
Records to collect
- Complete transfer deed
- care-related terms
- support and medical records
- communications and existing proceedings
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
The applicable family-law route depends on the marriage, personal or statutory law, parties and relief sought. Maintenance, protection, custody, divorce and property claims may proceed under different provisions. Existing orders must be disclosed and followed unless lawfully varied. A family relationship alone does not determine jurisdiction or every financial entitlement.
A practical next step
Prepare a promise-and-performance chronology. Assess the specific statutory conditions and competent forum before assuming the transfer can be undone.
