LEGAL GUIDE · MEDIATION AND ARBITRATION

Confidentiality in mediation — scope and exceptions

Mediation confidentiality depends on the governing law, rules, referral and agreement. It should not be described as an unlimited promise that every fact, document or later enforcement question can never be disclosed. Pre-existing evidence does not necessarily become unusable simply because it was discussed in mediation.

What to examine

Before the session, identify the applicable confidentiality and privilege framework, authorised participants and how documents will be shared. Ask how safety, legal obligations, recording of a settlement and enforcement issues are handled. Do not publish offers, recordings or private statements online. Keep the final settlement distinct from negotiation notes.

Records to collect

  • Mediation agreement or referral
  • applicable rules
  • document-sharing terms
  • final settlement if any

Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.

The applicable framework

Mediation is a process for exploring lawful agreement; arbitration is an adjudicatory process based on the applicable legal framework. The agreement, referral, institution and effective statutory provisions matter. A procedural label alone does not establish confidentiality, enforceability, court jurisdiction or the time available for a challenge.

A practical next step

Clarify confidentiality and permitted disclosure at the outset. Obtain specific advice before using or sharing anything said or prepared for the mediation.
