LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD
An overseas seller's Kashmir property transaction
An overseas seller should align authority, title clearance, buyer checks, execution and completion payments before a Kashmir property sale. A local agent's availability does not remove the seller's eligibility, tax, banking or registration questions.
What to examine
Read the POA for the precise acts authorised and identify who may receive money or deliver possession. Obtain qualified advice on withholding and other tax requirements. Keep originals and completion documents under a clear custody process. A sale should not proceed on an unexplained assurance that every overseas seller follows the same route.
Records to collect
- Title file
- limited authority
- buyer and payment documents
- banking and tax instructions
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.
A practical next step
Prepare a completion checklist with responsible people and documents. Confirm authority, funds and execution requirements before committing to a fixed signing date.
