LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD
Checking Kashmir property records while living overseas
Remote property monitoring should compare a known baseline with later official records and actual occupation. It is a way to identify changes requiring investigation, not a guarantee against fraud or a substitute for title due diligence.
What to examine
Maintain parcel identifiers, copies of instruments and the current authority given to representatives. Record when each extract was obtained and what changed. Check unexpected entries with their supporting orders. Avoid circulating identity papers or unrestricted POAs to multiple intermediaries simply to obtain information.
Records to collect
- Baseline title and revenue file
- parcel map
- authority register
- dated record comparisons
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.
A practical next step
Create a periodic record checklist and a clear escalation process for unexplained changes. Verify the transaction underlying a changed entry before drawing conclusions.
