LEGAL GUIDE · KASHMIR MATTERS FOR PEOPLE LIVING ABROAD
Suspected property fraud while the owner is abroad
An overseas owner who suspects property fraud should obtain a complete local record set and identify any immediate transaction or possession risk. A relative's report or online extract is a lead to verify, not a sufficient basis for a public accusation.
What to examine
Compare title documents, recent registered instruments, mutation history and authority granted to local representatives. Preserve original messages and payment evidence. If a transfer, construction or dispossession is threatened, explain the urgency separately; a copy request or complaint should not be assumed to stop the act automatically.
Records to collect
- Title chain
- recent deeds and revenue records
- POA and instructions
- dated suspicious communications
Keep complete, dated copies and preserve originals. Note which records are missing and where they may be requested; do not alter a document to fill a gap in the history.
The applicable framework
A Kashmir matter involving someone abroad can require both Indian legal compliance and documents executed in another country. Authentication, stamping, registration, authority and appearance are separate questions. An apostille or consular act does not by itself decide the underlying property right, foreign judgment effect or permission required by an Indian court.
A practical next step
Use a secure evidence index and clearly limited authority for local action. Assess civil protection and any criminal-law response on verified facts.
